O AMICUS CURIAE: PLURALIZAÇÃO E DEMOCRATIZAÇÃO DO DEBATE NAS AÇÕES DE CONTROLE ABSTRATO DE CONSTITUCIONALIDADE

O presente artigo tem como objetivo o estudo do amicus curiae no controle abstrato de constitucionalidade brasileiro, que constitui importante instrumento de regulação nos modernos Estados de Direito, e tem como objetivo a preservação da Constituição Federal e em consequência do ordenamento jurídico constitucional. A participação dos amicis curiae no controle abstrato de constitucionalidade possibilita a pluralização dos debates na medida em que exercem importante papel como auxiliares dos juízes com informações e conhecimentos, erigindo os valores da democracia, da soberania popular e do contraditório à condição de pilares do Estado brasileiro, além da democratização do exercício da função jurisdicional.

THE AMICUS CURIAE: PLURALIZATION AND DEMOCRATIZATION OF THE DEBATE IN CONSTITUTIONAL ABSTRACT CONTROL ACTIONS

This article aims to study the amicus curiae in the abstract control of Brazilian constitutionality, which is an important instrument of regulation in modern states of law, and has the objective of preserving the Constitution and as consequence of the constitutional order. The participation of amicis curiae in abstract control of constitutionality makes possible the pluralization of the debates as they play an important role as judges auxiliaries with information and knowledge, erecting the values of democracy, popular sovereignty and the contradictory to the condition of pillars of Brazilian State, besides the democratization of the exercise of the jurisdictional function.
