O presente artigo aborda a mudança realizada no direito probatório a partir da promulgação do Código de Processo Civil de 2015 da teoria da distribuição dinâmica das provas, no art. 373, §§ 1º e 2º, enquanto instrumento à disposição do juiz capaz de viabilizar a concretização de um justo processo. A pesquisa é de natureza teórico-bibliográfica seguindo o método descritivo-analítico que instruiu a análise da legislação constitucional e a infraconstitucional, bem como a doutrina que informa os conceitos de ordem dogmática.

THE BURDEN OF PROOF IN THE LIGHT OF FAIR LEGAL PROCEEDINGS IN THE CIVIL PROCEDURE OF 2015

The present paper addresses the change implemented in the law of evidence from the enactment of Brazilian 2015’s Civil Procedure Code which brought the theory of dynamic distribution of burden of proof (article 373, paragraphs 1st and 2nd), as a sufficient instrument available to help the judge to be capable to achieve the implementation of the fair legal proceedings. It is a theoretical-bibliographical-natured research guided by a descriptive-analytical method which had instructed the analysis of constitutional and infraconstitutional laws, as well as the doctrine that informs the concepts of dogmatic order.
