O núcleo desse artigo analisa a responsabilidade civil ambiental por dano nuclear bem como o nexo de causalidade e seus limites com base na legislação. Sendo assim, torna-se imprescindível uma completa regulamentação jurídica sobre o assunto e, em particular, propiciando, de um lado, o desenvolvimento de uma tecnologia que está voltada ao bem-estar do ser humano, da sua dignidade, do meio ambiente para que sua utilização se desenvolva de maneira segura e sustentável. A pesquisa é de natureza teórico-bibliográfica seguindo o método descritivo-analítico que instruiu a análise de leis, bem como a doutrina que informa os conceitos de ordem dogmática.

The core of this article analyzes the environmental civil liability for nuclear damage as well as the causal link and its limits based on legislation. Therefore, a complete legal regulation on the subject is essential and, in particular, providing, on the one hand, the development of a technology that is focused on the well-being of the human being, his dignity, the environment for its use to be developed in a safe and sustainable way. It’s a theoretical-bibliographical-natured research guided by a descriptive-analytical method about related laws, as well as the doctrine that informs the concepts of dogmatic order.
