O REFLEXO DO DEVER DE FUNCAMENTAÇÃO DAS DECISÕES NO EFETIVO CONTRADITÓRIO

O presente estudo analisa, na mudança legislativa atual, a importância do princípio do efetivo contraditório e seus reflexos na fundamentação das decisões, de forma a alcançar a democratização do processo jurisdicional. O trabalho se desenvolve a partir da análise dos referidos princípios processuais, buscando demonstrar a estrita vinculação entre eles e como tal vinculação proporciona a legitimidade da decisão judicial no Estado Democrático de Direito. Para o presente estudo, utilizou-se a pesquisa bibliográfica e o método dedutivo, adotando, como procedimento técnico, a análise temática, teórica e interpretativa, buscando sugestão para a solução da questão destacada.

THE REFLECTION OF THE DUTY OF FUNCAMENTAÇÃO THE DECISIONS ON EFFECTIVE CONTRADICTORY

This paper analyzes, in a democratic perspective, the principle of the effective contradictory and its impact on the motivation of judicial decision, in order to achieve the democratization of legal proceedings. The work develops from the analysis of these procedural principles, seeking to demonstrate the close links between them and as such linkage provides the legitimacy of the court decision in the democratic rule of law. For the present study, we used the literature and the deductive method, adopting, as a technical procedure, the thematic, theoretical and interpretative analysis, seeking suggestions for the solution of the outstanding issue.
