ANÁLISE DA PENHORABILIDADE DO BEM DE FAMÍLIA DO CONDÔMINO INADIMPLENTE: UM EXEMPLO DO CONSEQUENCIALISMO JURÍDICO NOS TRIBUNAIS

O presente estudo analisará a maneira com que os Tribunais Superiores, em especial o Superior Tribunal de Justiça, interpretaram o artigo 3º, IV, da Lei n. 8.009/90 antes da vigência do Código Civil de 2002. Demonstrar-se-á a tendência, ainda impregnada, dos Tribunais de se valerem de argumentos políticos para a formação das decisões judiciais, utilizando-se de justificativas consequencialistas, não levando a sério a garantia constitucional da fundamentação, a qual se encontra com maior expressão no CPC/2015.

The present study will analyze the way in which the Superior Courts, in particular the Superior Court of Justice, interpreted article 3, IV, of Law no. 8.009 / 90 before the Civil Code of 2002 will be in force. The tendency will still be felt for the Courts to use political arguments for the formation of judicial decisions, using consequentialist justifications, not taking seriously the Constitutional guarantee of justification, which is more expressive in CPC / 2015.
