A coisa julgada material institui a imutabilidade de decisão de mérito quando temos a renúncia ao direito de recorrer, a desistência do recurso proposto ou o esgotamento das vias recursais. A constitucionalidade da decisão de mérito não é pressuposto lógico para o trânsito em julgado. O direito pátrio admite o trânsito em julgado de decisões inconstitucionais. A querela nullitatis insanabilis é o instrumento processual que viabiliza, a qualquer tempo, o controle de constitucionalidade de decisões judiciais, já que seu objetivo é resguardar a segurança jurídica no Estado Democrático de Direito.

Material res judicata establishes the immutability of a decision on merit when we have a waiver of the right to appeal, the withdrawal of the proposed remedy or the exhaustion of the remedies. The constitutionality of the decision on merits is not a logical presupposition for a final decision. The right of the country allows for the adjudication of unconstitutional decisions. The querela nullitatis insanabilis is the procedural instrument that allows at any time the control of constitutionality of judicial decisions, since its objective is to safeguard legal security in the Democratic State of Law.
