A FILIAÇÃO NA SUCESSÃO - A necessidade de equiparação das filiações biológicas e socioafetivas para fins sucessórios

O presente trabalho analisa a necessidade de equiparação das filiações biológicas e socioafetivas para fins de direito sucessório. Com os avanços da sociedade, os institutos dos direitos das famílias devem ser remodelados à situação real dos indivíduos na sociedade. O trabalho pretende expor a desatualização da legislação do direito das famílias, haja vista a transformações diárias a que estão submetidas as famílias, consequentemente com a configuração do vínculo socioafetivo, está relação gerará efeitos, inclusive patrimoniais. Assim, no âmbito do direito sucessório, as filiações, seja biológica ou socioafetiva, devem ser equiparadas quanto a seus efeitos.

The present work analyzes the need for assimilation of biological affiliations and socioaffective for purposes of succession law. With the progress of society, the institutes of the family rights should be redesigned to the actual situation of individuals in society. The work seeks to expose the downgrading of family law legislation, given the daily transformations to which they are subjected, thus families with socioaffective link configuration is relationship will generate effects, including on-balance-sheet. Thus, under the law of succession, the affiliations, whether biologically or socioaffective, should be regarded as about its effects.
