Em busca de um procedimento célere e informal, a Lei dos Juizados Especiais Cíveis desconsidera a processualidade democrática; cada Juizado Especial possui uma legislação própria, aplicando o CPC, subsidiariamente, apenas no que lhe convém. Demonstrar-se-á, neste breve estudo, que o Novo CPC buscou racionalizar e preparar, ainda mais, as decisões judiciais através da fase de saneamento e organização do processo. A fase de saneamento e de organização do processo deve ser levada a sério no âmbito dos Juizados.

In search of a quick and informal procedure, the Law of Special Civil Courts disregards democratic procedurality; Each Special Court has its own legislation, applying the CPC, in the alternative, only in what suits you. It will be demonstrated, in this brief study, that the New CPC sought to rationalize and prepare, even more, the judicial decisions through the phase of reorganization and organization of the process.
