A Tomada de Decisão Apoiada, criada na Convenção das Nações Unidas sobre os Direitos das Pessoas com Deficiência e recepcionada pelo Brasil pelo Decreto nº 6.949/09, é um instituto novo no nosso ordenamento jurídico, sobre o qual paira certa incerteza quanto ao seu alcance, aplicabilidade, natureza jurídica, e, principalmente, os seUs efeitos. Busca-se, portanto, pesquisar acerca dos impactos positivos e negativos que poderão ser causados nas relações humanas, após a inclusão de instrumento tão desconhecido em nosso ordenamento jurídico, fazendo com que as pessoas e o poder público utilizem mais deste mecanismo, se assim for mais oportuno ao beneficiário.
