OS PRECEDENTES JUDICIAIS NO NOVO CÓDIGO DE PROCESSO CIVIL

O ordenamento jurídico nacional ainda não possui um sistema legal organizado e especificamente destinado a regulamentar a elaboração, interpretação e aplicação dos precedentes judiciais. É necessário estabelecer uma adequada compreensão dos novos institutos processuais elencados no artigo 927 do NCPC. O objetivo é demonstrar a necessidade de um referencial teórico sobre o common law e o civil law e de uma compreensão hermenêutica do fenômeno jurídico. A pesquisa é de natureza teórico-bibliográfica seguindo o método descritivo-analítico que instruiu a análise de leis relacionadas ao tema, bem como a doutrina que informa os conceitos de ordem dogmática.

THE JUDICIAL PRECEDENTS IN THE NEW BRAZILIAN CODE OF CIVIL PROCEDURE

The national legal order still does not have a legal and organized system specifically designed to regulate the establishment, interpretation and application of the court precedents. It is necessary to lay down an adequate comprehension of the new procedural institutes listed in 927 article of the NCPC. The aim is to prove the need of a theoretical background about the common law and the civil law and of a hermeneutical comprehension of the legal phenomenon. It is a theoretical-bibliographical-natured research guided by a descriptive-analytical method about related laws, as well as the doctrine that informs the concepts of dogmatic order.
