Discorre sobre o conteúdo do Digital Markets Act Europeu publicado no segundo semestre de 2022, com o objetivo de garantir competitividade entre os mercados digitais pela regulação das grandes companhias de tecnologia para se evitar que, abusando de seu poder de mercado, impeçam a entrada de novos concorrentes. A problemática cinge-se ao estudo do normativo, analisando os principais desafios de referida regulação, como as obrigações impostas às grandes empresas de tecnologia, a dificuldade de sua implementação e exigibilidade, o sucesso em reduzir a fragmentariedade de regulações no cenário europeu. Discorre sobre as características da estruturação da tecnologia de plataformas, com o denominado mercado de dois lados, seu desenvolvimento em camadas sucessivas e as regras inerentes ao sistema seja por meio de seus bloqueios técnicos, seja pelos conhecidos termos de uso. Por fim, verifica o impacto desta normativa para a inovação, investigando se as restrições impostas aos detentores da tecnologia de plataformas terão ou não o condão de prejudicar a sua ocorrência.

THE GATEKEEPERS REGULATION ACCORDING TO THE EUROPEAN DIGITAL MARKETS ACT: REGULATORY ADVANCEMENT OR RETROGRESSION FOR INNOVATION?

Discuss the content of the European Digital Markets Act published in the second half of 2022 which aims of ensuring fair competition in the European Digital Markets by regulating big technology companies from abusing their market power and preventing the entry of new competitors. The research focus on the study of the regulation, analysing challenges on this regulation, such as the obligations imposed on gatekeepers, the difficulty of implementation and its enforcement, the success in reducing the fragmentation on European regulations scenario. It discusses the characteristics of the structuring of platform technology, with the so-called two-sided market, its development in successive layers and the rules inherent to the system, either through its technical blocks or through the well-known terms of use. Lastly, this paper checks the impact of the Digital Markets Act on innovation investigating whether the imposed restrictions on platform technology holders will have the effect of hampering its occurrence.
