ATOS ANTIDEMOCRÁTICOS E A INOBSERVÂNCIA AO PRINCÍPIO DA IGUALDADE NO BRASIL: O DIREITO IGUALITÁRIO DE VOTO

Considerando manifestações sociais que ensejaram conquistas de importantes direitos em todo o mundo, como o direito igualitário de voto, observa-se na atualidade a ocorrência de atos que afrontam a democracia e as instituições democráticas, ferindo conquistas basilares para a sociedade, sobretudo no Brasil contemporâneo. Neste sentido, o objetivo geral desta pesquisa é compreender em que medida os ataques sofridos pela democracia recentemente, somado à inobservância do princípio da igualdade, ofendem a democracia e o direito à igualdade do (e ao) voto no Brasil. Esta pesquisa foi dividida em três momentos: inicialmente se estuda o princípio da igualdade, com ênfase para a sua evolução histórica. Em seguida, avaliam-se os principais aspectos relacionados ao direito ao voto. Por fim, a última parte estuda os atos antidemocráticos e os impactos da inobservância do direito à igualdade do voto no Brasil. Em termos de metodologia, trata-se de uma pesquisa básica e bibliográfica, que se realiza pelo chamado método hipotético-dedutivo. É uma pesquisa qualitativa e de caráter exploratório, a qual se desenvolve a partir de obras, periódicos e reportagens, alcançando considerações finais. Em termos de conclusão, verifica-se que o tema delimitado enseja um debate necessário. O direito igualitário de sufrágio faz com que cada voto tenha o mesmo peso, o mesmo valor, o que enseja respeito diante do histórico de conquistas, já que por muitos anos grupos sociais foram impedidos de exercer seu direito de cidadão. Assim, as conquistas de direitos precisam ser firmadas, fortalecendo a democracia.

ANTIDEMOCRATIC ACTS AND THE INOBSERVANCE OF THE PRINCIPLE OF EQUALITY IN BRAZIL: THE EQUAL RIGHT TO VOTE

Considering social manifestations that led to the conquest of important rights around the world, such as the equal right to vote, it is currently observed the occurrence of acts that confront democracy and democratic institutions, hurting basic achievements for society, especially in contemporary Brazil . In this sense, the general objective of this research is to understand to what extent the attacks suffered by democracy recently, added to the non-observance of the principle of equality, offend democracy and the right to equality of (and to) vote in Brazil. This research was divided into three moments: initially, the principle of equality is studied, with emphasis on its historical evolution. Next, the main aspects related to the right to vote are evaluated. Finally, the last part studies anti-democratic acts and the impacts of non-observance of the right to equal voting in Brazil. In terms of methodology, this is a basic and bibliographic research, which is carried out by the so-called hypothetical-deductive method. It is a qualitative and exploratory research, which is developed from works, periodicals and reports, reaching final considerations. In terms of conclusion, it appears that the delimited theme gives rise to a necessary debate. The equal right to suffrage means that each vote has the same weight, the same value, which gives rise to respect in view of the history of achievements, since for many years social groups were prevented from exercising their right as citizens. Thus, the conquests of rights need to be signed, strengthening democracy.
