JUDICIALIZAÇÃO DA SAÚDE E CONSELHO NACIONAL DE JUSTIÇA: uma análise da política pública para o aprimoramento da prestação jurisdicional nas demandas em saúde

A pesquisa teve por escopo analisar a atuação do Conselho Nacional de Justiça diante da complexa problemática da judicialização da saúde. O trabalho desenvolveu-se a partir da sistematização da política pública judiciária para melhoria da prestação jurisdicional em saúde. Utilizou-se o método descritivo exploratório com revisão bibliográfica e documental, realçando-se a apropriação de conceitos, como: judicialização da saúde, política pública judiciária e direito à saúde. Buscando-se, ainda, analisar a constituição da função política e instrumental do CNJ com a criação e instituição de órgão locais de condução de normativas e ações concretas na seara da judicialização da política.

JUDICIALIZATION OF HEALTH AND NATIONAL COUNCIL OF JUSTICE: an analysis of the public policy for the improvement of the jurisdictional provision in health demands

The scope of the research is analyze the work of the National Justice Council in face of the complex problem of health judicialization. The work developed from the systematization of public judicial policy to improve the jurisdictional provision in health. The exploratory descriptive method was used with bibliographical and documentary revision, emphasizing the appropriation of concepts, such as: judicialization of health, judicial public policy and right to health. It also seeks to analyze the constitution of the political and instrumental function of the CNJ.
