O ensaio trata de uma introdução histórica à disputa entre Hans Kelsen e Carl Schmitt sobre quem deveria ser o “Guardião da Constituição” através da exposição do “modelo austríaco” de controle de constitucionalidade e como Schmitt o criticou. Assim, ao final, este ensaio expõe a defesa de Kelsen sobre sua posição em relação a guarda da Constituição.

This paper is an introduction about the dispute between Hans Kelsen and Carl Schmitt on who who should be the “Guardian of the Constitution” by exposing the “Austriac model” of constitutional review and how Schmitt criticized it. So, in the end, this paper exposes the defense of Kelsen on its position about the guard of Constitution.
