O artigo estuda a natureza da função desempenhada pelo magistrado, no sentido de verificar se ele é um servidor público, que tem como função a aplicação da lei, como defende parte da doutrina, ou se ele é um agente político – tese defendida pelo Supremo Tribunal Federal e pelo presente trabalho – haja vista que no exercício da função judicante as decisões proferidas interferem nas outras esferas do poder do Estado. Para avaliar a natureza jurídica da função do juiz, o trabalho realizou resgate histórico do constitucionalismo moderno e deteve-se na análise dos movimentos de judicialização e ativismo judicial.

Judge, political agent or public server? Critical analysis of the legal nature of judicial function from constitutionalism modern and judicial activism

The article study the nature of the function performed by the magistrate, to see if it is a public server, which has the function of law enforcement, as advocates of the doctrine, or whether it is a political agent - argument put forward by Supreme Court and by this work - given that the exercise of adjudicative function judgments given interfere in other state spheres of power. To assess the legal nature of the judge's function, the work accomplished historical rescue of modern constitutionalism and stopped on the analysis of the movements of legalization and judicial activism.
